According to Yonhap News Agency and other media reports on December 18, the Constitutional Court of South Korea ordered President Yoon Seok-yeol on the 17th to submit the “12.3 Emergency Martial Law” related State Council meeting minutes and martial law proclamation and other materials before the 24th. The following is a related introduction:

Background of the incident: The South Korean National Assembly voted to pass the second impeachment motion against President Yoon Seok-yeol on the afternoon of December 14. Yoon Seok-yeol’s presidential duties were immediately suspended, and the impeachment case was transferred to the Constitutional Court of South Korea for final judgment. During this period, Prime Minister Han Deok-soo will perform the duties of the president.

Court requirements: The Constitutional Court requires Yoon Seok-yeol to submit materials including evidence plans, evidence lists, martial law-related State Council meeting minutes, and proclamation order No. 1 announced by the commander of the martial law headquarters, Park An-soo. The State Council meeting mentioned by the Constitutional Court refers to a meeting held from 10:17 to 22 before Yoon Seok-yeol announced the implementation of emergency martial law on the evening of December 3, and a meeting on the lifting of martial law held at around 4:15 a.m. on the 4th.

Delivery: The Constitutional Court sent the above order to Yoon Seok-yeol by electronic delivery on the 17th, and sent him an email again on the morning of the 18th, but it is currently impossible to confirm whether Yoon Seok-yeol has received the relevant instructions. Previously, the Constitutional Court sent the impeachment resolution and other relevant documents to the Presidential Office and Yoon Seok-yeol’s official residence on the 16th, but due to reasons such as “the recipient was absent” and “the presidential guard refused to receive it”, the relevant documents failed to be delivered to Yoon Seok-yeol.

Trial arrangements: The Constitutional Court also decided not to broadcast the trial of Yoon Seok-yeol’s impeachment case live, but the hearing, debate and sentencing process of the impeachment case are open to the public, the public can attend and the media can report.
